A BILL to amend article one, chapter twenty-three of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated
section one-a, relating to workers' compensation;
promulgation of rules; and amending Title 85 of the West
Virginia Code of State Rules, Series 1, §20.8.5(b) relating
to ventilatory function tests and providing that predicted
values shall be derived from the Morris nomogram and not
the Kory nomogram.
Be it enacted by the Legislature of West Virginia:
That article one, chapter twenty-three of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section one-
a, to read as follows:
ARTICLE 1. GENERAL ADMINISTRATIVE PROVISIONS.
§23-1-1a. Legislative rule change to §20.8.5(b) mandating
Morris nomogram to be used for predicted values in ventilatory function tests.
Title 85 of the West Virginia Code of State Rules, Series
1, §20.8.5(b), is hereby amended by striking the words
"Predicted values are derived from Kory's Nomogram" and
inserting in lieu thereof the words "Predicted values shall be
derived from the Morris Nomogram and not the Kory Nomogram."
NOTE: The purpose of this bill is to
amend Title 85 of the
West Virginia Code of State Rules, Series 1, §20.8.5(b) relating
to ventilatory function tests and providing that predicted
values shall be derived from the Morris nomogram and not the
Kory nomogram.
This section is new; therefore, strike-throughs and
underscoring have been omitted.
